Using This Website
You agree to use this website lawfully. You must not use it for fraudulent or unlawful purposes, attempt unauthorised access, introduce malicious code, interfere with its operation, commercially exploit website material without permission, or scrape information without authorisation.
We may suspend or restrict access where reasonably necessary to protect the website, the business or other users.
Website Information
We make reasonable efforts to keep information on this website accurate and current. Website content is provided for general information and we do not guarantee that all information will always be complete, accurate or up to date.
Products
The online shop may include original artworks, records, CDs, cassettes, prints, digital downloads and other merchandise. Some physical products may be produced or fulfilled to order by a third-party print-on-demand provider.
We take reasonable care to describe and display products accurately. Colours, appearance, scale, print placement, packaging and other details may vary slightly from photographs or on-screen previews because of differences in screens, production methods and materials.
Products are sold as shown on the website; custom or personalised orders are not accepted. All products are subject to availability. Original artworks and other one-off items are unique and may become unavailable once sold.
Intellectual Property
Unless otherwise stated, the content of this website, including artwork, images, photography, music-related artwork, text, graphics, branding and designs, belongs to or is licensed to Nasser Bouzida.
Purchasing an original artwork, print, record or other product does not transfer copyright or other intellectual property rights in the underlying artwork, image, design or creative work.
You must not reproduce, republish, distribute, sell, commercially exploit or create derivative works from website content or artwork without prior written permission, except where permitted by law.
Third-Party Services and Links
The website may use or link to third-party services, including Squarespace, payment providers and print-on-demand or fulfilment services. Third parties may operate under their own terms and privacy policies.
We are not responsible for the content, security or practices of unrelated third-party websites linked from this website.
Limitation of Liability
Nothing in these Terms limits or excludes liability where doing so would be unlawful or affects rights provided to consumers by law.
To the extent permitted by law, we are not responsible for indirect or consequential losses arising solely from use of this website or reliance on general website information.
Prices
Prices are shown in GBP (£).
Nasser Bouzida is not VAT registered, so VAT is not charged.
Delivery charges and any other applicable costs will be shown before you complete your purchase.
Prices may change at any time, but changes will not affect orders already accepted.
Placing an Order
When placing an order, you will have an opportunity to review your order before payment. By completing checkout, you acknowledge that the order involves an obligation to pay.
Your order is accepted when Squarespace sends the Order Confirmed email after checkout. For physical orders, we will send a separate email when the order is dispatched.
An order may be refused or cancelled where reasonably necessary, including where a product is unavailable, there is an obvious pricing or description error, payment is not authorised, fraud or misuse is suspected, or the order cannot be fulfilled.
If payment has already been taken for an order that cannot be fulfilled, the relevant amount will be refunded.
Payment
Payment can be made using the methods shown during Squarespace checkout.
Payments are processed through Squarespace Payments. Payment processing is subject to Squarespace Payments’ own terms and privacy policy.
Delivery and Fulfilment
Available delivery methods, estimated delivery times and delivery costs will be shown during checkout or in the Delivery, Returns & Refunds Policy.
Some print-on-demand products may be manufactured and dispatched by a third-party fulfilment provider. Items within the same order may be produced or dispatched separately.
We aim to deliver within the timeframe stated when you order. Unless a different timeframe has been agreed, goods will ordinarily be delivered within 30 days as required by applicable consumer law.
Delivery times are estimates unless expressly agreed otherwise. Please ensure the delivery information provided with your order is accurate.
For international orders, customers are responsible for any customs duties, import taxes or other charges imposed by the destination country. Unless stated otherwise, these charges are not included in the product price or delivery charge.
For artwork, records, CDs and cassettes dispatched by Nasser, orders are normally dispatched within 2–3 working days. This is a dispatch estimate, not a delivery-time guarantee.
Your Right to Cancel Online Purchases
If you are a UK consumer purchasing goods online, you will normally have the right to cancel your order without giving a reason.
For most eligible goods, you must tell us that you wish to cancel within 14 days beginning the day after you receive the goods. If an order contains multiple items delivered separately, the cancellation period will normally run from the day after you receive the final item. You then normally have a further 14 days to return the goods.
To cancel, contact nasserbouzidadrums@gmail.com. You may also use the model cancellation form at the end of these Terms.
Certain purchases are excluded from the statutory cancellation right, as explained below.
Exceptions to the Right to Cancel
The statutory right to cancel may not apply where an item is genuinely made to the customer’s specifications or personalised for that customer, or where another statutory exception applies.
A product being printed or produced only after an order is placed does not by itself necessarily make it personalised or remove statutory cancellation rights. Standard print-on-demand products should not be described as non-returnable solely because they are produced after ordering.
Certain sealed audio products may also fall within a statutory exception once unsealed, where the relevant legal conditions apply. Any exception relied upon will be communicated where applicable.
For digital downloads, if you give express consent for supply to begin during the 14-day cancellation period and acknowledge that you will lose your right to cancel, that right ends when supply begins.
Returns After Cancellation
If you cancel an eligible purchase, return instructions will be provided.
Direct exchanges are not offered. If you want a different eligible item, return the original item under the Delivery, Returns & Refunds Policy and place a new order.
Returns address: 13 York Road, Newbury, Berkshire, RG14 7NJ. For Printify-fulfilled products, please contact us first for the correct return instructions.
For change-of-mind returns, the customer is responsible for return postage costs, as explained in the Delivery, Returns & Refunds Policy. Faulty, damaged or incorrect goods are handled separately in accordance with statutory rights.
You should take reasonable care of goods while they are in your possession. A deduction from a refund may be made where permitted by law if handling has reduced the value of the goods beyond what would reasonably be permitted when examining them in a shop.
Refunds
For an eligible cancellation, we will refund the price paid for the goods. Where required by law, we will also refund the cost of the least expensive standard delivery option offered.
Additional amounts paid for premium or expedited delivery do not normally have to be refunded beyond the standard delivery amount.
Refunds will normally be made using the original payment method and within the period required by applicable consumer law.
Faulty, Damaged or Incorrect Goods
Your statutory consumer rights are not affected by these Terms.
If goods are faulty, damaged, not as described or otherwise do not meet the standards required by law, contact nasserbouzidadrums@gmail.com as soon as reasonably possible with your order details and, where helpful, photographs of the issue.
Faulty or incorrect goods will be dealt with in accordance with applicable UK consumer law. Where a product was fulfilled by a third-party provider, we may need information or photographs to raise the issue with that provider, but this does not remove your statutory rights against the seller.
Promotions and Discount Codes
Any promotional offer or discount code is subject to the specific conditions communicated with that offer. Unless otherwise stated, offers cannot be exchanged for cash, discounts cannot be applied retrospectively, only one code may be used per transaction, offers may have an expiry date, and certain products may be excluded.
Privacy and Cookies
Our collection and use of personal information is explained in our Privacy Policy.
Our use of cookies is explained through the website’s cookie information and cookie preference controls.
Changes to These Terms
We may update these Terms from time to time. The latest version will be published on this website and the “Last Updated” date will be amended.
Changes will not retrospectively alter contracts already entered into unless permitted or required by law.
Governing Law
These Terms are governed by the laws of England and Wales, unless mandatory consumer law requires otherwise.
If you are a consumer living elsewhere in the United Kingdom, you may also benefit from mandatory rights and may be entitled to bring proceedings in the courts applicable to where you live.
